1. Acceptance of Terms
By downloading, installing, or using the FittMatch mobile application or website at fittmatch.fit (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.
We may revise these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old to use FittMatch. By using the Service, you represent and warrant that:
- You are at least 18 years of age.
- You are either a fitness professional (coach, trainer, instructor) or a fitness business (gym, studio, club) seeking to hire.
- You have the legal capacity to enter into a binding agreement.
- Your use of the Service complies with all applicable laws and regulations in your jurisdiction.
3. Account Registration
You must create an account to access most features of the Service. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your account credentials confidential and not share them with any third party.
- Notify us immediately of any unauthorised access to your account.
- Be solely responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that contain false or misleading information.
4. User Conduct & Acceptable Use
You agree not to use the Service to:
- Post false, misleading, or fraudulent profile information.
- Harass, threaten, or intimidate other users.
- Send spam, unsolicited commercial messages, or repetitive content.
- Collect or harvest personal data from other users without their consent.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Upload or transmit viruses, malware, or any other harmful code.
- Use the Service for any unlawful purpose or in violation of any applicable regulation.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
5. Content & Intellectual Property
You retain ownership of content you submit to FittMatch (profile text, photos, messages). By submitting content, you grant FittMatch a non-exclusive, worldwide, royalty-free licence to use, store, display, and distribute that content solely to operate and improve the Service.
All other intellectual property on the Service — including the FittMatch name, logo, design, and software — is owned by FittMatch and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
6. Matching & Messaging
FittMatch facilitates introductions between coaches and gyms through a mutual-match mechanism. A match is created only when both parties swipe right on each other's profile or listing. Messaging is available exclusively to matched pairs.
FittMatch is not a party to any employment, contractor, or service agreement reached between users through the platform. Any such agreements are solely between the users involved, and FittMatch accepts no liability in connection with them.
7. Subscriptions & Billing
FittMatch offers a free tier with limited daily swipes and a paid "FittMatch Pro" subscription for gym and studio accounts that unlocks unlimited daily swipes and additional discovery features.
- Subscriptions are offered on weekly, monthly, and annual billing cycles.
- All payments are processed through the Apple App Store. Your purchase is subject to Apple's payment terms.
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date in your App Store account settings.
- Refunds are handled in accordance with Apple's refund policy. FittMatch does not issue refunds directly.
- We reserve the right to change subscription pricing with reasonable notice.
8. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
FittMatch does not guarantee that:
- The Service will be uninterrupted, error-free, or secure.
- Any match will result in employment or a business relationship.
- User profiles are accurate, complete, or truthful.
9. Limitation of Liability
To the fullest extent permitted by applicable law, FittMatch and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of or inability to use the Service.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim or (b) USD $100.
10. Indemnification
You agree to indemnify, defend, and hold harmless FittMatch and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Pima County, Arizona.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
